These Terms and Conditions ("Terms") govern your access to and use of PRONOX ("the Service", "we", "us", "our"), a bulk WhatsApp, Email, and SMS marketing platform owned and operated by NOX INFOTECH. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
You must be at least 18 years old and legally capable of entering into a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You agree to use the Service only to send messages to recipients who have given consent to be contacted, and in compliance with applicable laws including India's IT Act, TRAI regulations, and WhatsApp's Business Policy. You must not use the Service to send spam, unsolicited bulk messages, phishing content, or any unlawful, defamatory, or harmful material. We reserve the right to suspend or terminate accounts found in violation of this policy, without refund.
Access to the Service is offered through subscription plans and/or a pay-as-you-go wallet system. Prices are as displayed at the time of purchase and are subject to change with notice. Wallet top-ups and plan purchases are processed upon admin verification of payment. Usage of messaging credits, devices, connections, and API access is governed by the limits of your active plan.
The Service integrates with third-party platforms such as WhatsApp, email service providers, and SMS gateways. Your use of these integrations is also subject to the respective third party's terms. We are not responsible for outages, policy changes, or account restrictions imposed by these third parties.
The Service, including its software, design, and branding, is the property of NOX INFOTECH and is protected by applicable intellectual property laws. You retain ownership of the content and customer data you upload, but grant us a limited license to process it solely to provide the Service.
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, NOX INFOTECH shall not be liable for any indirect, incidental, or consequential damages, including loss of data, revenue, or business, arising from your use of the Service.
We may suspend or terminate your access to the Service at our discretion for violation of these Terms, non-payment, or misuse that risks the platform's standing with WhatsApp or other providers. You may stop using the Service and close your account at any time.
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Kollam, Kerala.
